Important Change to NSW SafeWork Licences

Following an amendment to the WHS Regulation in December 2017, the NSW Government published a register of high-risk work, asbestos and demolition licence holders, and general construction induction training cardholders.

It has been designed to make managing a business easier by allowing businesses and consumers to check the validity of workers' licences/cards and make informed decisions regarding contractors they engage.

Phase 1 release of the register on 29 January 2018 included publication of the licence/card holder's name, licence number and type, licence status, and the licence expiry date (if any).

Phase 2 release of the register on 31 May 2018, will include:

  • licence/card holder’s name
  • licence number and type
  • licence status
  • licence expiry date (if any)
  • licence conditions
  • prosecution summaries
  • information about any penalty notices issued in connection with the licence.

It is important to note that only the penalty notices issued by SafeWork NSW on or after 1 July 2018 will be published on the register. This will allow licence holders time to implement safe systems of work to ensure compliance with work health and safety laws.

The final policy for publishing penalty notice will be made available on the SafeWork website on 18 June 2018.
